Purchase Conditions

These general contracting conditions are applicable to all commercial transactions carried out in our virtual store www.otrajoyashop.com, hereinafter referred to as the Seller. For more information about the Seller and our Privacy Policy please consult the Legal Notice located at the bottom of each page of this store.

Please read these Purchase Conditions and our Privacy Policy carefully before placing an order. If you do not agree with all of the Purchase Conditions or with the Privacy Policy, you should not place an order.

 

1. Activity

The Seller is devoted to the sale of jewellery.

 

2. Content and information supplied on the website

The Seller reserves the right to modify the commercial offer presented on the website (modifications of products, prices, promotions and other commercial conditions and of service) at any time. The Seller shall make all reasonable efforts to offer the information contained on the website with accuracy and without typographical errors. In the event that this type of error should occur at any time, completely unconnected to the Seller’s intentions, it shall be corrected immediately. Should there be a typographical error in the any of the prices shown and a client makes a decision to buy based on said error, the Seller shall inform the client of said error and the client shall be entitled to cancel the purchase without any cost for the latter.

The contents of the website may, on occasions, show provisional information regarding some products. In the event the information provided does not correspond to the characteristics of the client’s product, the latter shall be entitled to cancel his/her purchase at no extra cost.

The Seller is not directly or indirectly responsible for any information, content, manifestation and expression contained by the products sold by the Seller. Said liability corresponds at all times to the manufacturers or distributors of said products. The client understands that the Seller is merely an intermediary between the former and said manufacturer or distributor.

 

3. Clients’ obligations

The Seller’s Clients undertake to provide at all times true information regarding the data requested in the user registration forms or order forms, and to keep said information updated at all times.

Clients undertake to accept all of the provisions and conditions contained in these General Contracting Conditions, with the understanding that they contain the intention to provide the best possible service for the type of activity carried out by the Seller. 

Likewise, Clients undertake to maintain with utmost diligence their personal password to our website in a confidential manner. 

Clients undertake to enable delivery of the order placed by providing an address at which the order can be delivered within the normal timetable for the delivery of goods (from Monday to Friday, from 10:00 to 1:30 PM and from 4:00 to 6:00 PM). In case of non-compliance by the client of this obligation, the Seller shall not be liable for any delays or impossibility of delivery of the order placed by the client.

 

  1. 4. Taxes

Residents of the European Union:

The prices of products that are on sale in our e-commerce stores include the Added Value Tax (V.A.T.).
Purchases that are made by VAT taxpayers (companies, entities, organizations…) residents of the European Union and holders of intra-community tax number shall be exempt from the VAT, subject to sending said document by email to info@otrajoya.net.

Residents in non EU-member countries:

Purchases made by natural persons or legal entities residents of non EU-member countries are exempt from VAT payment. Orders shall not be sent to Post Office boxes.

For this system of delivery, and given their tax system, Ceuta and Melilla are considered as non EU-member countries.   

You are reminded that the prices indicated for shipping fees do not include import duties, which must be paid in cash at the place of destination by the receiver of the goods.  

The purchase system is subject to legislation in force in Spain. In consequence, the sale operations shall be deemed to take place at the registered address of Otrajoya.

 

5. Governing law and competent jurisdiction

Purchases made from the Seller are subject to the legislation of Spain. In the event of any conflict or discrepancy, the applicable jurisdiction shall be that of the Courts and Tribunals of Cordoba.
